1. These general terms of use (“Terms”) govern the relations between “S PROPERTIES” LTD, UIC 207643289, hereinafter referred to as “S PROPERTIES” for short, as the Provider, on one side, and the Users of the website, located at http://www.sproperties.bg, hereinafter referred to as “Users,” on the other side.
“S PROPERTIES” LTD offers the content of this website under the following terms:
This document and the privacy policy determine the use of this site. If you do not agree with these terms, you should leave the site. “S PROPERTIES” LTD reserves the right to change these documents at any time without notice. These terms were last modified on 16.12.2024. By accessing and using this website, you agree and are bound by the terms described here, as well as the Cookie Policy and the Privacy Policy published on the site.

1.2. The company operates in accordance with the legislation of the Republic of Bulgaria, including the Consumer Protection Act and the Personal Data Protection Act.
1.3. The company’s activity is not subject to licensing.
Please read the published Terms of Use in full before using the informational and commercial services offered on the Site (hereinafter referred to as “Services”).
If you do not accept the Terms stated here, you will not be able to use some of the services provided through the website. By using our services, it will be considered that you agree to the Terms. In connection with the provided Services, www.sproperties.bg processes personal data in accordance with the Privacy Policy (“Policy”), which is visible and easily accessible on our website.
I. Definitions
For the purposes of these general terms, the following terms shall be understood as follows:
Website – http://www.sproperties.bg and all its subpages.
Profile/Account – this is the User’s account on the website www.sproperties.bg. The account is created after the User voluntarily provides certain data, which allows access to certain services provided by the website of S PROPERTIES.
User/Client – means any person who has accessed the website of S PROPERTIES, www.sproperties.bg.
General Terms – these General Terms /Rules of Use/ and their amendments, available at www.sproperties.bg.
Active behavior means clicking/selecting an electronic link or banner through www.sproperties.bg, redirecting the user to other websites.
Personal data – information about a person – full name, email, phone.
Web page – this is an integral and distinct part of the site.
Registered User – a person who has accessed the S PROPERTIES site after creating a profile/account by entering the necessary data.
Unregistered User – a person who has accessed the S PROPERTIES site without registering.
Alternative dispute resolution procedure – a procedure for out-of-court resolution of consumer disputes, meeting the requirements of the law and carried out by a body for alternative dispute resolution.
II. The website www.sproperties.bg does not contain rights and obligations regarding contracts between S PROPERTIES and the User if the latter is a potential Seller/Buyer/Lessor/Lessee of real estate. The relationships between the two parties are regulated entirely by individually drawn contracts on paper, and the registration and visits of Users to the website are not considered the conclusion of a distance contract. The contracts that the parties draw up to regulate their relations can be Service Agreement, Guarantee Agreement, Advertising Agreements, and others not exhaustively listed here. The possibilities for payments under the contracts concluded between S PROPERTIES and the User are described below in these General Terms, and the payments, prices, conditions, deadlines, and amounts are regulated in individual contracts concluded between the parties.
III. S PROPERTIES is a professional intermediary in real estate transactions and currently does not provide its services through the website.
Access to services provided through the website is possible only by using the publicly accessible web page www.sproperties.bg. The site contains materials with informational data provided by S PROPERTIES, as well as by third parties. S PROPERTIES is not responsible for informational data provided by third parties.
IV. The website of S PROPERTIES www.sproperties.bg is accessible to Users who have agreed to the site's General Terms. The site distinguishes between Registered and Unregistered Users.
Registered Users are Users who have registered on the site and have provided their data necessary to create a profile/account. These Users have the right to access and edit their personal data in their profile.
Unregistered Users are Users who use the possible services of the site without registering and without creating their profile/account.
V. Rights and obligations of S PROPERTIES regarding the website
V.1. S PROPERTIES has the right to publish any information on its website related to its intermediary activity, including images, texts, information from its database for the purpose of advertising and promoting individual offers. It has the right to publish articles, news, legal materials, links to legislative acts, which Users can access for free on the site.
V.2. S PROPERTIES undertakes to update all information contained on the website. Other than the above, S PROPERTIES is not responsible for the validity and accuracy of the published information.
V.3 Users declare that they are aware that the prices indicated on the site are indicative at the time of publication. They do not constitute and do not bind Users with an offer to buy, sell, rent, or other service. These prices are subject to change at any time by S PROPERTIES. Furthermore, the characteristics of the properties are not guaranteed by S PROPERTIES, may not correspond to the actual parameters, and may differ from reality.
V.4 S PROPERTIES’ services are provided for a fee – for an individual remuneration due by any User/Client who decides to use S PROPERTIES’ services, which fee is negotiated individually between the parties depending on the service provided or other grounds agreed between the parties. Users/Clients cannot claim compensation for damages and/or lost profits resulting from the use of the website.
V.5. S PROPERTIES undertakes to process Users’ personal data lawfully and in good faith.
- S PROPERTIES has the right to unilaterally terminate or restrict, without notice, access to the website for certain Users in the following cases:
a/ The User disseminates via Internet, SMS, or by using services through the S PROPERTIES website, messages with advertising, commercial, obscene, offensive, defamatory and/or threatening texts and/or images, including on religious, confessional, or political grounds, as well as those with pornographic content;
b/ The User, through their actions, damages the good name of S PROPERTIES, violates the laws of the Republic of Bulgaria, or threatens the software and technical means through which the services are provided.
c/ In the case of unlawful actions as per the previous point and/or upon request from competent Bulgarian authorities, S PROPERTIES has the right to provide all available information about the User’s actions and identity to the competent authorities.
d/ S PROPERTIES has the right to require additional information and/or declarations from Users as per the Measures Against Money Laundering Act and related regulations, regarding the execution of a specific transaction.
e/ S PROPERTIES has all other rights and obligations regulated by applicable law and these General Terms.
V.6. S PROPERTIES undertakes to exercise due care to ensure that the User has normal access to the services provided.
VI. Rights and obligations of the User regarding the use of the website
VI.1. The User is obliged to comply with the provisions of these General Terms.
VI.2. Creating an Account on the S PROPERTIES site is possible after providing personal data by the User. At S PROPERTIES’ discretion, additional information may be required.
VI.3. The User may not alter, publish, delete, copy, distribute, or otherwise disclose data or information obtained from visiting the S PROPERTIES website, unless explicitly agreed.
VI.4. The User undertakes not to provide their login credentials to other Users, as well as not to provide their Account for use by other Users.
VI.5 The User may not take actions that could impede or affect the functioning of the website, which could restrict access to it for other Users.
VI.6. By creating an Account on the website and accepting these General Terms, the User gives their explicit, freely expressed, and informed consent for the processing of their personal data. Users’ personal data will be collected and processed by S PROPERTIES in accordance with the Personal Data Protection Act and the Privacy Policy, which is an integral part of these general terms, available on the S PROPERTIES website.
VII. Payment options.
VII.1 The User may pay S PROPERTIES in the following ways:
- in cash at the S PROPERTIES office against a financial document
- by bank transfer to S PROPERTIES’ accounts in “UniCredit Bulbank” AD and “Allianz Bank Bulgaria” AD.
VII.2 If the User’s payment to S PROPERTIES is equal to or exceeds 10,000 BGN or the equivalent euro value after exchange at BNB’s central rate on the payment date exceeds 10,000 BGN, payment is made only by bank transfer to an S PROPERTIES account.
VII.3 The amount due is determined according to a valid and signed individual Agreement/Annex/Other documents governing the relationship between the parties.
VII.4 If S PROPERTIES and the User agree on a refund of amounts received by S PROPERTIES in one of the ways mentioned above, the parties settle their relations by an Annex, Agreement, Protocol, or other document signed by both parties.
VIII. Intellectual property
Intellectual property rights to all materials and resources, trademarks, copyrights, intellectual property rights, etc., located on the S PROPERTIES website (including databases) are protected under the Copyright and Related Rights Act and belong to S PROPERTIES or the respective person who has assigned the right to use to S PROPERTIES and may not be used in violation of applicable law.
Copying or reproducing information beyond what is permitted, as well as any other violation of the intellectual property rights to S PROPERTIES’ resources, gives S PROPERTIES the right to claim compensation for direct and indirect damages in full amount.

X. Links to this site
Creating links to this site is prohibited without the express consent of “S PROPERTIES” LTD. Links to it should not use techniques to present its content as related to your organization. For all matters not regulated by these General Terms, the provisions of the current legislation of the Republic of Bulgaria apply.
S PROPERTIES identifies Users of the site by storing log files on the Site server.
S PROPERTIES has the right to collect and use information about Users on the basis and for the purposes of performing the contract concluded with the User under general terms. Information by which the person can be identified may include personal data specified in the general terms, as well as any other information voluntarily provided during registration. The information also includes any other information entered, used, or provided by the User when using services.
S PROPERTIES exercises due care and is responsible for the protection of information about the User, known to it in connection with the registration, except in cases of force majeure, accidental event, or malicious acts of third parties.
S PROPERTIES may disclose personal data to third parties only in the cases and under the conditions provided by law or with the explicit consent of Users.
S PROPERTIES and all its managers, employees, or representatives are not personally or otherwise liable for losses or damages suffered by the User or others, including, but not limited to, any direct, indirect, punitive, or consequential damages or losses, missed income, profits, reputation damage, loss of data, orders, use of funds, as well as losses or damages arising from or connected in any way with the interruption of activity, whether based on a claim for negligence, contract, or otherwise, in connection with the use of the website or with the use, inability to use, or results of the use of the website, or the type of content provided on the website; errors or omissions in the content; websites linked to the website, or the materials of such websites, including losses or damages due to viruses that may affect the User’s computer equipment, software, data, or other property due to actions taken and access to, use or viewing of the website, or downloading by the User of materials from the website or websites linked to the website. These terms do not exclude or limit the liability of S PROPERTIES, which cannot be excluded or limited under the applicable law at the time of the claimed event that caused damages.
S PROPERTIES does not provide warranties that the services and/or products of the site will meet the User’s requested goals. The operators, managers, and/or owners of the website are not responsible for damages resulting from acquisitions, special offers, promotional offers, professional promotions, or other relationships, transactions, or collaborations that may be carried out between Users and any of the persons who directly or indirectly advertise on the S PROPERTIES website.
These General Terms /Rules of Use/ do not contain information on delivery policies for goods and services, methods of delivery, deadlines, values, additional costs and/or restrictions, order cancellation policies, return policies, refund policies for payments made by Users, due to the fact that S PROPERTIES and the User do not conclude a contract through the website, as well as that all agreements between the two parties are reached with negotiations and agreements incorporated into a separate written contract.

Users may use the European online dispute resolution platform (ODR), available at http://ec.europa.eu/odr – a single access portal allowing consumers and traders in the EU to settle their disputes.
Alternative dispute resolution (ADR) between consumers and traders is an out-of-court conciliation procedure on a voluntary basis.
General conciliation commissions assist in reaching an agreement between consumers and traders in disputes regarding contracts for the sale of goods and provision of services.
The general conciliation commissions are determined on a regional basis, and the competent body to resolve disputes between S PROPERTIES and the User is the General Conciliation Commission based in Sofia, with a territorial scope covering Sofia region.

S PROPERTIES reserves the right to suspend access to part or all of the website, without the User’s consent, for an unlimited period, whether planned or accidental, without liability for any damages resulting from the suspension for the User.
S PROPERTIES reserves the right to change, without prior notice, the structure and/or content of the website.
